Dr. Nicholas R. Palenker
Bio:
Nicholas is a senior associate with Noerr PartGmbB and a member of Noerr's Restructuring & Insolvency and Private Equity practice groups. He specialises in complex restructurings, transactions in special situations, insolvency law and corporate law. His clients include companies in distressed situations, its shareholders, insolvency administrators and creditors including syndicated lenders and debt investors. He is the author of various publications, in particular on distressed debt investments and the German Act on the Stabilisation and Restructuring Framework for Businesses (StaRUG).
Before joining Noerr, Nicholas worked as an academic assistant with Professor Dr. Christoph G. Paulus, LL.M. (Berkeley), at the Humboldt University of Berlin for more than four years. He taught property law as well as civil procedure law and conducted research in bankruptcy and securities law with a particular focus on distressed debt investments. Nicholas’ Ph.D. thesis on loan-to-own strategies for which he completed a visiting scholar program at the University of California, Berkeley, was awarded with the Uhlenbruck-Award of the German Association of Insolvency Administrators. The thesis compares German and U.S. restructuring practice and encompasses a proposal for new disclosure requirements in the claims trading market.
He studied at the Humboldt University and graduated with special honors receiving the faculty award for the best core subject in European and international private and commercial law. After participating himself, he coached the Humboldt team for the Willem C. Vis Moot. Within his law degree, Nicholas interned at the legal department of a medical supply company in Chicago, Illinois. During his law and his Ph.D. studies, he was a fellow of the Ernst Ludwig Ehrlich scholarship program.
